Social Security Institution Biometric Authentication System has come into force again as of today following the decision of the Supreme Court.
In the lawsuit filed by the Health and Social Service Workers Union, according to the decision of the Council of State 15th Department dated 11.09.2014, the process related to biometric authentication in private hospitals and the execution of the relevant parts of the SUT (Health Application Notification), the base of this process, was stopped.
Social Security Institution (SSI) published an announcement on “Biometric Authentication System” dated 08.11.2014, following the decision of suspension of execution taken by the 15th Department of the Council of State. In this announcement, it was informed that as of 08.11.2014, provision can be obtained from the MEDULA system without using the biometric authentication system and the regulations to be made regarding the biometric authentication system will be announced on the institution portal.
In the decision of the Supreme Court published in the Official Gazette dated 03.04.2015, “added to the third paragraph of Article 67 of the Social Insurance and General Health Insurance Law dated 31.05.2006 and numbered 551 with Article 1 of the Law No. 6283 of 01.03.2012 the statement of ”… authentication using biometric methods and / or… ” is not contrary to the Constitution of the republic of Turkey and the decision of rejection for the objection has given. In accordance with the decision of the Supreme Court, the decision of suspension of execution was abolished by the Council of State.
In the statement published by the SSI on April 30, “Currently, provision can be obtained from the MEDULA system by using the biometric authentication system, provided that the explicit consent of the person is obtained without using the biometric authentication system. However, as of 15.05.2015, in accordance with the provisions of the relevant legislation, no provision will be given in the MEDULA system without using the biometric authentication system, except in exceptional cases, in the applications made to private health service providers by our corporation. In this context, the private health service providers must take all necessary precautions and complete their preparations until 15.05.2015 in order to ensure that people whose health aids are met by our corporation do not experience unjust treatment in their applications to private health service providers.” statements took place. Accordingly, it became clear that no provision will be given from the MEDULA system without using the biometric authentication system.
The above-mentioned general health insurance holders will be able to receive health services if they apply to health service providers with their identity card, driver’s license, passport or marriage certificate.
